Анотація: This book is open access under a CC BY 4.0 license This book explores the magical and medical history of executions from the eighteenth to the early twentieth century by looking at the afterlife potency of criminal corpses, the healing activities of the executioner, and the magic of the gallows site. The use of corpses in medicine and magic has been recorded back into antiquity. The lacerated bodies of Roman gladiators were used as a source of curative blood, for instance. In early modern Europe, a great trade opened up in ancient Egyptian mummies and the fat of executed criminals, plundered as medicinal cure-alls. However, this is the first book to consider the demand for the blood of the executed, the desire for human fat, the resort to the hanged man’s hand, and the trade in hanging rope in the modern era. It ends by look at the spiritual afterlife of dead criminals.

Анотація: This book is open access under a CC BY 4.0 licence. This book is a multidisciplinary work that investigates the notion of posthumous harm over time. The question what is and when is death, affects how we understand the possibility of posthumous harm and redemption. Whilst it is impossible to hurt the dead, it is possible to harm the wishes, beliefs and memories of persons that once lived. In this way, this book highlights the vulnerability of the dead, and makes connections to a historical oeuvre, to add critical value to similar concepts in history that are overlooked by most philosophers. There is a long historical view of case studies that illustrate the conceptual character of posthumous punishment; that is, dissection and gibbetting of the criminal corpse after the Murder Act (1752), and those shot at dawn during the First World War. A long historical view is also taken of posthumous harm; that is, body-snatching in the late Georgian period, and organ-snatching at Alder Hey in the 1990s.

This volume provides a series of illuminating perspectives on the timings of death, through in-depth studies of Shakespearean tragedy, criminal execution, embalming practices, fears of premature burial, rumours of Adolf Hitler’s survival, and the legal concept of brain death. In doing so, it explores a number of questions, including: how do we know if someone is dead or not? What do people experience at the moment when they die? Is death simply a biological event that comes about in temporal stages of decomposition, or is it a social event defined through cultures, practices, and commemorations? In other words, when exactly is death? Taken together, these contributions explore how death emerges in a series of stages that are uncertain, paradoxical, and socially contested.   .

Анотація: This volume addresses the problem of small, irregular, and unconventional war across time and around the globe. The use of non-uniformed and often civilian combatants, with tactics eschewing pitched battles, is the most common form of warfare throughout history and comes in many forms. The collection works back in time beginning with the ‘Long War’ in present day Afghanistan and concluding with warfare in classical Greece. Along the way it engages with conflicts as diverse as the American Civil War and regional rebellion in Tudor England. Each case study provides unique insights into the practices, experiences, and discourses that have shaped this ubiquitous type of conflict. Анотація: This innovative volume examines the nexus between war crimes trials and the pursuit of collaborators in post-war Asia. Global standards of behaviour in time of war underpinned the prosecution of Japanese military personnel in Allied courts in Asia and the Pacific. Japan’s contradictory roles in the Second World War as brutal oppressor of conquered regions in Asia and as liberator of Asia from both Western colonialism and stultifying tradition set the stage for a tangled legal and political debate: just where did colonized and oppressed peoples owe their loyalties in time of war? And where did the balance of responsibility lie between individuals and nations? But global standards jostled uneasily with the pluralism of the Western colonial order in Asia, where legal rights depended on race and nationality. In the end, these limits led to profound dissatisfaction with the trials process, despite its vast scale and ambitious intentions, which has implications until today.

Анотація: Since its accession to the World Trade Organisation (WTO) in December 2001, China has been committed to full compliance with the Trade-Related Intellectual Property Rights (TRIPS) Agreement. This text considers the development of intellectual property in China, and offers an interdisciplinary analysis of China’s compliance with the TRIPS Agreement using theories originating in international relations and law. It notes that despite significant efforts to amend China’s substantive IP laws to prepare for WTO accession and sweeping changes to domestic legislation, a significant gap existed between the laws on paper and as enforced in practice, and that infringements to the agreement are still prevalent. The book examines how compliance with international rules can be promoted and encouraged in a specific jurisdiction. Making a case for a wider, more interdisciplinary and global outlook, it contends that compliance needs to align with the national interests of relevant countries and jurisdictions, as governments’ economic interests support the greater enforcement of the IP laws. .

Анотація: This book analyses the punitive crime discourse in the Argentinean press during the 1990s. Fernandez Roich focusses on several features of media discourse during this time, such as: the notion that petty criminals ‘deserve to die' in reference to police brutality and killings, the phenomenon of ‘vindicators’ or how common citizens turned into ‘evil’ modern heroes in the press, and the parallelism between the military discourse under the military regime and the punitive discourse under democracy. In addition, the book also investigates the alleged natural propensity towards breaking the law ingrained within Argentinean culture, the so-called 'viveza criolla' and the well-ingrained idea that to get ahead you have to participate in corrupt practices. Despite the significant scholarly interest in the United States and Europe in the last Argentinean dictatorship (1976-1983), little attention has been paid to the role of Argentinean newspapers in supporting the military coup d’etat. The analysis of this media discourse is critical to understanding the support enjoyed by the armed forces in power: the vast majority of the population was not informed about the disappearances or the concentration camps until well into the 1980s. This project provides an in-depth qualitative content analysis of front pages, chronicles, editorials and photographs of Argentinean newspapers before and after the military intervention that will aid scholars of criminal justice and Latin American political regimes understand the impact of the support given to the military government.

Анотація: This edited collection focuses on the sociology of 'social censure' – the sociological term advocated by Colin Sumner in his seminal writing of the 1980s and 1990s. Social censure has become increasingly important in contemporary criminological writing. Анотація: This book provides a unique insight into the lived realities of hate crime in Ireland and its treatment within the criminal justice system. The significance of the Irish case is contextualised within the European and global policy contexts and an overview of hate crime in Ireland, both north and south, and its differential treatment in each jurisdiction’s criminal justice system is offered. Presenting empirically grounded analyses of the experiences of commonly targeted identity groups in an Irish context, this study also draws upon their exposure to hate crime and challenges encountered in seeking redress. Combining theory, research and practice, this book represents legal, social, cultural and political concerns pertinent to understanding, preventing, deterring and combatting hate crime across Ireland. It incorporates a variety of perspectives on the hate crime paradigm and addresses many of the cutting-edge debates arising in the field of hate studies. Contributions from Irish and international academic researchers are complemented by applied pieces authored by practitioners and policy makers actively engaged with affected communities. Анотація: This book presents an in-depth analysis of how statutory and third sector organisations have faced the challenge of dealing with former ‘terrorists’. Offering a theoretically robust, empirically rich account of work with ex-prisoners and those considered ‘at risk’ of involvement in extremism in the United Kingdom, Marsden dissects the problems governments are facing in dealing with the effects of 'radicalisation'. Increasingly, governments are struggling with the challenge of dealing with those who have become involved in extremism, and yet, comparatively little is known about how and why people renounce violence. Nor are existing efforts to ‘deradicalise’ extremists well understood. Arguing that reintegration is a more appropriate framework than ‘deradicalisation’, Marsden looks in detail at the mechanisms by which people can be supported to move away from extremism. By drawing out implications for policy, practice and academic debates around disengagement from radical subcultures, this book makes a significant contribution to an issue only likely to grow in importance for scholars of criminological theory, terrorism and justice. Sarah Marsden is a Lecturer in the Department of Politics, Philosophy and Religion at Lancaster University, UK.

Анотація: This is a comparative study of prisoners' human rights in England, Wales and the Netherlands. Over the years changes in Dutch penal policy have smoothed to some degree the sharp contrasting differences that were once characteristic of the English and the Dutch prison systems. In this context, the study documents the impact of the two countries' penal policies on prisoners' human rights and presents prisoners' views on the human rights contribution to prison life and prisoner treatment. English and Dutch prisoners treat human rights recognition and protection as the yardstick of the prison's legitimacy in contemporary democracies. Drawing on their respective experiences, Karamalidou highlights valuable lessons on what practices to adopt and what practices to cease with a view to embedding human rights in prison.
